Elon Musk's immigration story rarely makes headlines. However, the billionaire tech mogul shared some details on his platform X over the weekend. These revelations came after the Washington Post published a report alleging that Musk worked illegally in the US during the 1990s.

The Washington Post, citing court records, company documents, and former business partners, claimed that Musk began his career in the US illegally. A former CEO stated that investors were concerned about Musk's risk of deportation.

Musk denied these allegations on X:

"I was allowed to work in the US," he said and accused President Biden of lying.

Musk stated that he transitioned from a J-1 visa to an H-1B visa. However, experts say there are still many questions about how this transition occurred.

Details of J-1 and H-1B Visas

  • J-1 Visa: Issued for those participating in exchange programs for education or research. Usually requires a sponsoring program like a university.
  • H-1B Visa: Provides temporary work authorization in the US for specialty occupations.

Immigration attorney Greg Siskind noted that while transitioning from J-1 to H-1B is possible, a student would lose their work status when leaving an educational program:

"If Musk was working without being enrolled in a full-time educational program, he may have violated his status."

Missing Information in Musk's Immigration Journey

Musk came to the US in 1992 with Canadian citizenship and studied at the University of Pennsylvania. Although he was later accepted into Stanford's graduate program, he chose to start a business before beginning his studies. This situation raises questions about how legal work authorizations were obtained during that period.

Musk's brother Kimbal Musk had previously mentioned that investors pointed out their illegal immigrant status. Elon Musk described this situation as a "gray area."

Perspective on Immigration Policies

Musk has recently gained attention for his anti-illegal immigration stance. However, the ambiguities in his own immigration history have led some circles to criticize this as "hypocrisy." Immigration expert Greg Siskind summarizes this situation:
